What is personal data?

Personal data means data relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to a commonly used identifier or another identifier such as a name, surname, identification number, location data or an online identifier, or by reference to one or more characteristics or features that constitute their physical, physiological, genetic, mental, psychological, economic, cultural or social identity.

What is personal data processing?

Processing of personal data means an operation or set of operations performed on personal data or on sets of personal data, in particular collection, recording, organisation, structuring, storage, alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction or erasure, whether or not carried out by automated means.

The controller is not obliged to appoint a Data Protection Officer.

2. Sources and categories of personal data

The controller processes personal data that you have provided directly to the controller, or personal data obtained in the course of fulfilling your order: your identification and contact details and the data necessary for the performance of the contract.

3. Legal basis and purpose of processing

The legal basis for processing is:

• Performance of the contract between you and the controller pursuant to Article 6(1)(b) GDPR
• The controller's legitimate interest in providing direct marketing pursuant to Article 6(1)(f) GDPR
• Your consent to the processing of personal data for direct marketing purposes pursuant to Article 6(1)(a) GDPR

The purpose of processing personal data is:

• Handling your order and exercising the rights and obligations arising from the contractual relationship between you and the controller. When placing an order, the personal data necessary for its successful handling (name, address, contact details) are required pursuant to Article 6(1)(b) of the Regulation (this also covers the subsequent payment, delivery of goods or services, handling of complaints, etc.); the customer's personal data are processed without the customer's consent, as the legal basis for processing their personal data for the purpose of performing the contract is the specific distance contract concluded between the customer and the controller. The provision of personal data is a necessary requirement for concluding and performing the contract; without the provision of personal data, it is not possible to conclude the contract or for the controller to fulfil its terms.
• Sending marketing offers and carrying out other marketing activities.
• Social networks: promotion of the company via the social networks Facebook, LinkedIn and Twitter

The controller does not carry out automated individual decision-making within the meaning of Article 22 GDPR.

4. Retention period

The controller retains personal data:

• For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from these contractual relationships.
• Until consent to the processing of personal data for marketing purposes is withdrawn
• Once the retention period arising from Act No. 395/2002 Coll. on Archives and Registries, as amended, has expired, the controller erases the personal data.

5. Recipients of personal data

Who is a recipient?

A recipient is anyone to whom personal data are disclosed, regardless of whether they are a third party. A public authority processing personal data on the basis of specific legislation is not considered a recipient.

• The controller does not transfer, publish or make personal data available to third countries

6. Personal data security

The controller declares that it has adopted appropriate personnel, technical and organisational measures to ensure the protection of personal data.

The controller has adopted technical measures to secure data storage as well as storage of personal data in paper form.

The controller declares that personal data are accessible only to persons authorised by the controller.

7. Your rights

Under the conditions set out in the GDPR, you have:

• The right of access to your personal data pursuant to Article 15 GDPR
• The right to rectification of personal data pursuant to Article 16 GDPR
• The right to restriction of processing
• The right to erasure pursuant to Article 17 GDPR
• The right to object pursuant to Article 21 GDPR
• The right to data portability pursuant to Article 20 GDPR
• The right to withdraw consent (electronically or by post to the correspondence address)
• The right to lodge a complaint with the Office for Personal Data Protection if you believe that your personal data protection rights have been violated.

8. How can you exercise your rights?

a. Right of access

You have the right to know whether we process your personal data. If we do, you may request access to them. Based on your request, we will issue a confirmation with information about the processing of your personal data. b. Right to rectification

You have the right to have the personal data we process about you be accurate, complete and up to date. If your personal data are inaccurate or outdated, you may ask us to correct or complete them, either electronically at the e-mail address info@trinetus.com or by post to the correspondence address: Farská 1342/50, 949 01 Nitra, Slovakia.

c. Right to erasure

Under certain circumstances, you have the right to have your personal data erased. You may request the erasure of your data at any time. We will erase your personal data if:

• we no longer need your personal data for the purpose for which you provided them,
• you withdraw your consent,
• you object to the processing of your personal data,
• we process your personal data unlawfully,
• the personal data must be erased in order to comply with a legal obligation,
• you are a child, or the parent of a child, who consented to the processing of personal data online.

d. Right to restriction of processing

You may ask us to restrict the processing of your personal data. If we grant your request, we will only store your personal data and will not process them further. Processing of your data will be restricted if:

• you notify us that your personal data are inaccurate, until we verify their accuracy,
• we process your personal data unlawfully, but you do not agree to their erasure and instead request that we only restrict the processing of your personal data,
• we no longer need your data, but you need them to establish, exercise or defend your legal claims,
• you object to the processing of your personal data, until we verify whether our legitimate interests override your grounds.

e. Right to data portability

You have the right to ask us to provide your personal data in electronic form (e.g. an XML or CSV file) that allows you to easily transfer the data to another company. You may also ask us to transfer your personal data to a selected company directly. We will comply with your request provided that you provided the personal data to us directly and gave us your consent to their processing.

f. Right to object

You have the right to object to the processing of your personal data. If we process your personal data in the following cases:

• on the basis of our legitimate interest,
• for the creation of a customer profile,
• you may object to their processing if you have personal grounds for doing so.
